LET THE ECONOMICALLY BACKWARD CATEGORY USE THE BENIFITS OF RESERVATION,FOR WHOM ITS REALLY MEANT ....... STRIKE TO INTRODUCE INCOME CRITERIA ALSO...... GREATEST SOLUTION.......... first of all i wld like to make clear tat i am nt against reserved cat students, infact i have many freinds who r res. cat and i didnt even know tat before this issue arose.i wld like to ask all those who r pro reservation few Q. i reqest those to PLZ answer it honestly n sincerely-1]if u trust ur abilities n intelligence why do u need crutches of reservation? 2]even babasaheb ambedkar studied under very much adverse conditions n became a respected SCHOLAR, u people r doctors n have got more opportunites to prove urself still nobody has got guts to deny resevation? 3] didnt u people ever believe the facts tat raja rammohan roy,tilak, agarkar, gokhale belonged to d so called upper castes who were responsible for upliftment of the truly needy people? 4]do u think caste based reservation is the only n fullproof method of upliftment? 5] does babasaheb ambedkar medicos asscn has some solid plans other than reservations for the upliftment of the truly needy lower caste people who dont even know what basic education means? 6] how can eqality be achieved by reservation policy if one section of bahujan samaj doesnt even have access to basic needs n other section of the same samaj is enjoying the benfits of it? PLZ REPLY TO THIS PKTK, DR FAT EAGERLY WAITING.[/size]

hi all friends.. i agree with drGiMiC.. i think we all students should fight a case _ reservation for economically backward class people, may it be of open category, which is really needed..n all class people should support it.. dont be aggressive n self centered..realise the need for the uplifment of our country.. we all are educated people n cant behave like others or like some polititions...dont fight n do which is really right n needed...THINK ... icon_idea.gif icon_idea.gif

I hav few ideas regarding how the upliftment can be brought about for the really needy people of the lower castes or the weaker sections of the entire indian society, whichever is given the priority!
1] Dr. Babasaheb Ambedkar has taught- Agitate, Educate n Organise. I think these words hav much wider meanings.
Agitate- not for ur personal problems but for the common problems of the society. not for ur own progress but for the collective progress of the society.
Educate-means to get knowledge n to spread the same. It does not mean to get degrees! All the people of the community should be aware of the happenings around them n in this world.
Organise- To achieve the above goals they should hav a Single Well Organised body which should be non political, unbiased n preferably not based upon the caste system.
2] When such a organisation is estblished, it will include all those who r frm lower castes and hav talent n knowledge to help weaker sections of the society to come forward. Like Doctors can arrange free health camps once a month or a week at the grassroot level, where free consultancy n T/t can be done. By doing this nearly dying Govt Health System will be supported n quack practices will stop. Engineers n other traders who r owners of the big companies n firms should pick up the talents from lower castes n arrange for their employment, insurance etc. 3] When a great, united n NONPOLITICAL orgn is established it can pressurise Govt, who apparently has a pro reservation stand, to make available all the basic needs like food, shelter, clothing n primary education, without descriminating them into upper n lower class.
4] Now regarding reservations- today indian society has accepted reservations which is already there.It is seen that only few reserved cat students r benifited by it n rest r not. It is not because the quantity of reservation is less but because of the faulty implimentations of the already wrong policies. If a caste based reservation is restricted to only one or max two generations i.e. till a family achieves social n financial stability and then if made non available for the same family, it will definitely benifit other families, at the same time it will teach a lesson to all those selfish people who inspite of having a sufficient economical n social power were using reservations for their own progress.
5] To bring about the above changes those open cat people who hav got a social sense will also come forward with monetary as well as moral support. But to make India a Developed contry n not a Developing contry of the Developed politicians, drastic changes in the mindset n attitudes of the well educated people of backward class should occur.
Why Dr Babasaheb Ambedkar is the only mentor of weaker sections? WHY; Arjun Sing, Mayavati, Ramvilas Pasvan, Laluprasad Yadav, Chhagan Bhujbal, Prakash Ambedkar, Ramdas Athawle r not considered as Indian Idols if they r working for upliftment of Backard Class people? PLEAZE THINK! PLEAZE THINK !!

I waited fr 2 days n now completely disappointed by seeing the response this thread has got! This clearly shows the true intentions of the people who r demanding reservations every now and then! I can predict wht will happen in the future if the reservation policies remain=
1] Caste based quota will increase over next few years to such an extent tat only an open cat. student who is extra ordinarily brilliant will be able to survive the competition.
2]Most of the remaining open cat. students who will hav the abilities n opportunities will hav to leave India , their" SWADES", never to return back! They will establish themselves like Parsis and Jews who hav left their original contries.
3]Here in India caste based politics will be at its peak and few open cat. people will try to adapt to their new lifestyles, I hope they succeed in that.
4] Truely needy weaker sections of the society will not even survive as they wont be given any chance and opportunity fr their progress, the so called upper class people will also be the sufferers.
4] Every political party will hav quotas fr various posts, and the so called representatives of the weak and poor people will hav their multiple accounts in Swiss Bank.
5]This will widen the already existing social n economic gap which will lead to tremendous increase in crime n violence.
6] Remember in Mahabharata, after the death of Shri Krishna most of the descendents of him, Yadavas, died because of their utterly selfish nature as they all had lost their Conscience. Similar situation will arise in India.
7] Finally India will be a powerless contry, when even our small neighbour Pakistan will be able to conqer it. USA and UK r just waiting for a chance like this to take over India.
To prevent these horrible things frm happening and to make India a Developed nation all of us should not only think but act collectively and appropriately.

Yes the non creamy layer concept needs to be implemented in all reservation categories with zero tolerance policy towards the offenders who misuse the reservation policy and deprive the real needy people of their rights.

Persons/Sections Excluded from Reservation which constitute Creamy Layer of the Society

Creamy Layer

Description of category To whom rule of exclusion will apply
I. Constitutional Posts Sons and daughter(s) of –
(a) President of India;
(b) Vice-President of India;
(c) Judges of the Supreme Court and of the High Courts;
(d) Chairman and Members of UPSC and of the State Public Service Commission; Chief Election Commissioner; Comptroller and Auditor-General of India;
(e) Persons holding constitutional positions of like nature.
II. Service Category

A. Group ‘A’/Class I Officers of the All India Central and State Services (Direct Recruits) Son(s) and daughter(s) of –
(a) parents, both of whom are Class I officers;
(b) parents, either of whom is a Class I officer;
c) parents, both of whom are Class I officers, but one of them dies or suffers permanent incapacitation;
(d) parents, either of whom is a Class I officer and such parents dies or suffers permanent incapacitation and before such death or such incapacitation has had the benefit of employment in any International Organisation like UN, IMF, World bank, etc., for a period of not less than 5 years;
(e) parents, both of whom are Class I officers die or suffer permanent incapacitation and before such death or such incapacitation of the both either of them has had the benefit of employment in any International Organisation like UN, IMF, World Bank, etc. for a period of not less than 5 years;

Provided that the rule of exclusion shall not apply in the following cases :-
(a) Sons and daughters of parents either of whom or both of whom are Class I officers and such parent(s) dies/die or suffer permanent incapacitation;
(b) A lady belonging to OBC category has got married to a Class I officer, and may herself like to apply for job.
B. Group ‘B’/Class II Officers of the Central and State Services (Direct Recruitment) Son(s) and daughter(s) of –
(a) parents, both of whom are Class II officers;
(b) parents of whom only the husband is a Class II officer and he gets into Class I at the age of 40 or earlier;
(c) parents, both of whom are Class II officers and one of them dies or suffers permanent incapacitation and either one of them has had the benefit of employment in any International Organisation UN, IMF, World Bank, etc., for a period of not less than 5 years before such death or permanent incapacitation;
(d) parents of whom the husband is a Class I officer (direct recruitment or pre-forty promoted) and the wife is a Class II officer and the wife dies; or suffers permanent incapacitation; and
(e) Parents, of whom the wife is a Class I officer (Direct Recruit or pre-forty promoted) and the husband is a Class II officer and the husband dies or suffers permanent incapacitation;

Provided that the rule of exclusion shall not apply in the following cases:-

Sons and daughters of –

(a) Parents both of whom are Class II officers and one of them dies or suffers permanent incapacitation.
(b) Parents, both of whom are Class II officers and both of them die or suffer permanent incapacitation, even though either of them has had the benefit of employment in any International Organisation like UN, IMF, World Bank, etc, for a period of not less than 5 years before their death or permanent incapacitation.
C. Employees in Public Sector Undertakings, etc. The criteria enumerated in A and B above in this category will apply mutatis mutandis to officers holding equivalent or comparable posts in PSUs, Banks, Insurance Organisations, Universities, etc., and also to equivalent or comparable posts and positions under private employment, pending the evaluation of the posts on equivalent or comparable basis in these institutions, the criteria specified in Category VI below will apply to the officers in these Institutions.
III. Armed forces including Paramilitary Forces (Persons holding civil posts are not included). Son(s) and daughter(s) of parents either or both of whom is or are in the rank of Colonel and above in the Army and to equivalent posts in the Navy and the Air Force and the Paramilitary Forces;
Provided that –
(i) If the wife of an armed forces officer is herself in the armed forces (i.e., the category under consideration) the rule of exclusion will apply only when she herself has reached the rank of Colonel;
(ii) the service ranks below Colonel of husband and wife shall not be clubbed together;
(iii) if the wife of an officer in the armed forces is in civil employment, this will not be taken into account for applying the rule of exclusion unless she falls in the service category under item No. II in which case the criteria and conditions enumerated therein will apply to her independently.
IV. Professional class and those engaged in Trade and Industry

(i) Persons engaged in profession as a doctor,lawyer, chartered accountant, income tax consultant, financial or management consultant,
dental surgeon, engineer, architect, computer specialist, film artists and other film professional, author, playwright, sports person, sports professional, media professional or any other vocations of like status.

Criteria specified against Category VI will apply
(ii) Persons engaged in trade, business and industry. Criteria specified against Category VI
will apply.
EXPLANATION –
(i) Where the husband is in some profession and the wife is in a Class II or lower grade employment, the income/wealth test will apply only on the basis of the husband’s income.
(ii) If the wife is in any profession and the husband is in employment in a Class II or lower rank post, then the income/wealth criterion will apply only on the basis of the wife’s income and the husband’s income will not be clubbed with it.
V. Property Owners

A. Agricultural holding. Son(s) and daughter(s) of persons
belonging to a family (father, mother and minor children) which owns-

(a) only irrigated land which is equal to or more than 85% of the statutory ceiling area, or
(b) both irrigated and unirrigated land, as follows:-
(i) The rule of exclusion will apply where the pre-condition exists that the irrigated area (having been brought to a single type under a common denominator) 40% or more of the statutory ceiling limit for irrigated land (this being calculated by excluding the unirrigated portion). If this pre-condition of not less than 40% exists, then only the area of unirrigated land will be taken into account. This will be done by converting, the unirrigated land on the basis of the conversion formula existing, into the irrigated type. The irrigated area so computed from unirrigated land shall be added to the actual area of irrigated land and if after such clubbing together the total area in terms of irrigated land is 85% or more of the statutory ceiling limit for irrigated land, then the rule of exclusion will apply and disentitlement will occur.)
(ii) The rule of exclusion will not apply if the land holding of a family is exclusively unirrigated.
B. Plantations

(i) Coffee, tea, rubber, etc.

(ii) Mango, citrus, apple plantations, etc.
Criteria of income/wealth specified in Category VI below will apply.
Deemed as agricultural holding and hence
criteria at A above under this category will apply. Criteria specified in Category VI below will apply.
C. Vacant land and/or buildings in urban Agglomerations. EXPLANATION:- Building may be used for residential, industrial or
commercial purpose and the like two or more such purposes.
VI. Income/Wealth Test Son(s) daughter(s) –

(a) Persons having gross annual income of Rs. 1 lakh or above or possessing wealth above the exemption limit as prescribed in the Wealth Act for a period of three consecutive years.
(b) Persons in Categories I, II, III and V-A who are not disentitled to the benefit of reservation but have income from other sources of wealth which will bring them within the income/wealth criteria mentioned in (a) above.

EXPLANATION:-
(i) Income from salaries or agricultural land shall not be clubbed;
(ii) The income criteria in terms of rupee will be modified taking into account the change in its value every three years. If the situation, however, so demands, the interregnum may be less.

EXPLANATION—Wherever the expression “permanent incapacitation” occur in this schedule, it shall mean incapacitation which results in putting an officer out of service.
