Dear friends,
You may be aware of or not that there is a case still pending in the Hon. Supreme court regarding the 4th round of the Maharashtra PGMCET 2006 councelling.
The case was filed earlier in the Hon. High court on 28th june, i.e. before the cut off date 30th sept. to avoid loss of the valuable PG seats dut to cancellation or not joining of students to the courses alloted to them in third round.
Hon. High Court Said that it cannot interfere in this matter as the cut off date was decided by Hon. Supreme court and advised to appeal for the same in Supreme Court.
Now we have our case in Supreme Court and we are getting only further dates of hearing as our ADVOCATE for this case is not strong.
WE are with the hope to win the case as a total of 96 seats are getting lapsed. And in emergency and exceptional cases MCI can extend joining/councelling upto 3 months after cut off date.

For the same reason U.P. had made admissions after the cut off date on 5th july with permission of MCI through Supreme COURT.
We have less than a month in our hand So that 4th round is implimented, DMER is also ready to take 4th round before 30th sep. if Court permits as they have submitted their Affidavit to Sup. Court
Reply from MCI is not recieved yet and thats why our case is getting delayed.
We need a strong ADVOCATE which can resolve this matter in the stipulated time, So anybody can help out or Knows any good Supreme court advocate please get in touch.

REJOINDER AFFIDAVIT OF PETITIONER

I, Dr. Rahuldeo Madhukar Wagh, Age major, Occ: Student, R/o Pune, Maharashtra , presently at New Delhi do hereby state on solemn affirmation as under that:
1. I am the authorized representative of Petitioner-Association, well conversant with the facts of the case and hence competent to swear this rejoinder affidavit.
2. I have read the contents of the counter affidavit of the respondents and in reply to the same, I am filing this rejoinder affidavit only for the purpose to oppose the same and I further reiterates the contents of the List of Dates and contents of the Special Leave Petition as a part and parcel of this rejoinder affidavit for the sake of brevity and convenience. I further reserve my rights to file detailed affidavit, if required at a later stage with the kind permission of this Hon’ble Court.
3. I submit that the of Petitioner-Maharashtra Association of Residents Doctors, Pune deals with the problem of resident doctors and the matters related to post graduate education. Regarding this petition, I would like to point out that the exact number of post graduate seats which are likely to go waste is around 120, though earlier it was accepted to be around 80, as some seats are not mentioned in the earlier affidavit. So this figure of vacant seats comes around 20 to 22 % (120 out of 535).
4. In my respectful submission, I would further like to point out certain misleading points of the affidavit, that was put forth by the respondent, a before the honorable court as a reply in this petition.
5. It is claimed by the respondent that the vacancies are created due to reasons attributable to the students who rejected the seat, however this is not the fact, as vacancies are due to inefficient admission procedure adapted by DMER, and thus the responsibility of filing those seats lies totally on DMER, as there are still number of eligible candidates waiting down the merit list to get those seats.
6. To explain, in previous method of counseling (face to face counseling), if the student who has already taken seat through All India Quota, leaves the same for better option available in state quota, that particular seat was used to be made immediately available to the next eligible candidate in the same round. Therefore there was no such question of seats remaining vacant due to any action on behalf of students.
7. But in present counseling method (Preferences filing system) if any student from All India Quota leaves the seat for better option available through state quota in last round then such seat will remain vacant forever, unless the authority conducts another round.
8. For this year, when the third round was conducted between 26 to 30th June 2006, no compulsion was made by respondent on the student to continue the seats allotted to prevent possible vacancies and wastage of seats, neither the students were given any option to resign the seat before a due date so that possible vacancies could have been avoided before the deadline of admission.
9. Ultimately, in this scenario, the responsibility lies on DMER, and it is itself evident that procedure adapted is faulty as it is creating so many vacancies (20%) in spite of so many eligible candidates awaiting admission.
10. Further, whatever may be the reason for vacancies, it is ultimately responsibility of the respondent to make sure that there should not be so many vacancies at the end of due date.
11. As mentioned in the orders passed by this honorable court in the matter of Mridul Dhar Vs Union of India (2005) SCC 65 (paragraph F of page 71).
“ It is necessary to adhere to the schedule so the remaining unfilled seats can be reverted and be filled by the state and only bare minimum number of seats may lapse, the state shall also take timely action so that the seats to a great extent may not lapse.”
12. Hence, I would like to bring to the attention of this honorable court the amount of seats which are going to lapse is more than 20% of the total seats available, which definitely can not be called as “bare minimum” even in gross words and respondent had failed to take timely action to fill up the vacant seats, as it clearly evident.
13. As it is persistently claimed by the respondent in the affidavit that the procedure adopted by them for admission, is very transparent and single window system. I respectfully would like to bring to the attention of this honorable court that, I had never raised questions about transparency of procedure; I firmly reiterate that the procedure is seriously inefficient.
14. The selection list for third round was declared on 26 June 2006 and students were asked to join on or before 30 June 2006. In this scenario the respondent is claiming that, if there were any vacancies arising after this round, would have been identified only on 1 July 2006, which is post due date of 30 June 2006. But I respectfully submit that the extent of wastage of seats would have been limited if the respondent would have scheduled the third round dates somewhat earlier by two or three days thus creating opportunity for one more round within due date.
15. For unknown reasons, the last date of joining for private medical colleges was 29 th June 2006 while the same for govt college was 30 June 2006. Thus the private colleges had one more day to fill up the vacancies before the deadline, while the govt institutions were denied such opportunity.
16. In last year for 2005 – 2006 on 29 may 2005 morning candidates were asked to fill fresh preferences form, on the same day evening new selection list was displayed and on the same day night candidates were asked to join colleges on next day. This is an example to show that how fast the respondent can act if they desire. This is very contrary to their present statement which claims that it was not possible for them to fill the seats at 11th hour.
17. As a representative of Maharashtra Association of Resident Doctors, I would like to bring to the attention of this honorable court, the very important fact that these postgraduate seats are the backbone of the huge infrastructure of medical colleges and hospitals, which forms tertiary level of healthcare system throughout the state which is basically run for healthcare of common people. So with such kind of seat wastages the infrastructure is likely to suffer.
18. Furthermore, this will be serious injustice to the student who study rigorously for 2-3 years after their degree completion and in spite of holding a good rank in the merit list, are denied the admission. Solely because of faulty procedure adopted by the authorities.
19. Finally, I would like to summarize as a) The likely number of the seats wasted is approximately 120, which more than 20%of the total available seats. b) The affidavit filed by DMER is misleading. c) Respondent is solely responsible for the seat wastage and not the students. d) It was possible from the respondent to minimize the wastage by properly planned and timely action which the respondent failed to take. e) With such huge number vacancies the healthcare infrastructure is likely to suffer and final brunt will be on poor patients. f) These vacant seats will be severe injustice to the students holding good ranks, still waiting for admission.
20. Certified that no new facts have been stated in this rejoinder affidavit.
