Calcutta HC stays post-grad OBC quota

In a jolt to the Centre, the Calcutta High Court on Wednesday stayed quota for Other Backward Classes in post- graduate courses in the Indian Institute of Management, Calcutta, and stopped the interview of OBC candidates for the same.
Justice Maharaj Sinha, in an ex-parte interim order, granted the stay on a petition by Sayan Guha, a B-Tech student challenging the Human Resource Ministry's memorandum and also the IIM-C interview scheduled for Thursday.
The interim order stayed the operation of the reservation clause of IIM prospectus and also the resolution of office memorandum dated April 20, 2008, passed by the HRD Ministry. The matter would come up for hearing again on June 9.
The IIM-C had scheduled the special interview of OBC students following the HRD memorandum. Guha's counsels Kishore Dutta and Nilava Bandopadhyay told the court that the office memo and the subsequent reservation clause were in violation of the April 10 Supreme Court order on reservation of OBCs, that had set a yardstick for such quotas and defined the creamy layer that would be out of the purview of reservation.
They said while the apex court had directed that graduates would not be considered for reservation, the HRD ministry had, in violation of that, passed an office memo to the effect that OBC students would get reservation in post-graduate courses. No counsel appeared for the HRD Ministry and the IIM-C.

Calcutta HC stay on OBC quota: Centre moves SC

The Centre on Thursday approached the Supreme Court to seek vacation of the Calcutta High Court order -- staying the implementation of a government memorandum relating to 27 per cent quota for Other Backward Classes -- in postgraduate course in the Indian Institute of Management - Calcutta.
The apex court said that the matter would be listed for mentioning on Friday.

Guys, BAD NEWS.
The news are showing it. The apex court has vacated the stay order given by the Calcutta high court, and allowed reservation in PG courses.
It seems the judgement has been modified, i dont know what.
Now we general category candidates have 2 hopes: 1.) That it will not be adopted in AIPG because it is not Central institute 2.) If they increase the number of seats so that the seats in the general category remain unaffected.
The PGI hall ticket says that "additional seats" have been declared for the OBC candidates for this session. Does that mean that the general category seats remain the same ?? Right now there are 68 in general, 12 in OBC, 12 in SC, 7 in ST, 4 in rural, 2 in OPH. and quite a few in the sponsored/deputed categories. On the site, the previous notification is as it is, with the same number of seats in general, and there is a separate notification mentioning 12 "additional" seats in the OBC category!! In case the number of seats have been increased in PGI, i guess that should apply to AIPG too. In that case, there should not be much to worry about.
What do you say guys ?? Illuminate me.

yeah its bad news guys...be ready for worst dont know why SC dont want to clear confusion.But they have mentioned all admissions will be provisional untill final decision will come out.
Apex court says admissions in post graduate courses in Central educational Institutions will be provisional and will be subject to the outcome of the final order in the matter, pending before it.

oh my god these politicians are making us to go thru hell..the iim alumni had given a case against the obc quota in delhi high court...now if the YFE will give a case against this...both of them have the best lawyers in the country....
but still how the supreme court can give a verdict in support of obc quota...already a very strong judgement against reservation is present...
these politicians are changing the judges ...they will appoint those who are supporting them for reservation for the final judgement...
no use of staying in this country..fly from here...no1 to protect us....
if we ask any mp or mla where his son or daughter is studying- their reply will be US or UK..or ask them where they are going for treatment --that too will be US or UK...in TOI-delhi one report had come says that NETAS HEADING TO COOLER PLACES TO STUDY "........" IN THE MIDDLE OF SUMMER... this they are doing unanimously...no party difference or disagreement ...
unless and otherwise we raise our voice against these people's idiocracy and win over them ...we will are the one's going to loose....

ya guys this is a bad news.....
Apex court stays all proceedings relating to OBC quota that are pending in the High Courts of Delhi, Calcutta and Bombay and now hearing of all these cases will be done in supreme court. but the court is going on vacations and hearing on the issue of keeping graduates outside the quota will take place only in july and till this time obc reservation will be imlemented in all iim's, AIIMS
, pgi .
though the court has said that admission in all post graduate courses will be provisional and subjected to final verdict on this issue by the court, but in india once it is implemented it is very difficult (though not impossible) to revert back.
judiciary is under tremendous preesure 4om centre . also there has been a history of some top judges favouring centre after being given lucrative offers of positions like chief election commisionar after their retirement. i hope this bench will not bow under centre's pressure and will keep our faith in judiciary alive.
dont lose hope guys... fight is still on

friends i feel even if obc is allowed(hope it dosent) in PG courses,implementing it might me diff...1st colleges should increase seats so that GM seats are not affected...looking at the pethetic situation of our govt colleges,MCI may not give recog to the increased seats cauz there are not enough profess,infrastructures etc etc...so we all can take this point and fight in SC...but hope that OBC is not implemented in AIPG at first place...
