Hi,

My boyfriend and I will be getting married later in the year. he's from Brazil and is currenly here on a student visa. He's been in the country for about 5 years.

his current student visa expires less than a month after we will marry, when we will then apply for a spouse visa.

Reading just now it appears to say that he needs at least 3 months left on his visa so he can apply for a spouse visa.

Can anybody confirm if this is correct?

Hope we don't have to change the date, we've already paid a lot of money for the wedding!

Sorry I am not very sure about it. But you'll find the answer once you go to UK immigration and asylum website (from home office website). Open the law and policy and you'll get some thing about it.
May be you can try to get extension on fiance status.
