Professional college: Another plea in HC
Chennai, Jul 15 - A petition was today filed in the Madras High Court, seeking to stay part of a single judge's order yesterday, directing that unfilled seats in aided and unaided minority professional colleges in Tamil Nadu be surrendered to the state and that non-minority colleges be governed by the rule of reservation.
Yesterday, Justice D Murugasen, while setting aside a part of the order by a Permanent Committee constituted by the state to work out the mode for admissions, had exempted minority-run engineering colleges from following the rule of reservation and the single-window system but directed that they surrender unfilled seats of the 70 per cent allotted to the institutions for admitting their respective community students.

In its writ petition, the All-India Medical and Engineering Colleges Association contended that the directions given by Justice Murugasen were contrary to the law laid down by the Supreme Court in the TMA Pai Foundation case and Islamic Academic of Education case.

"Unless an urgent order of stay is granted, members of the petitioner's colleges will be constrained to follow rule of reservation and surrender the unfilled seats to the state, which will result in great hardships to the institutions," the association contended.

The petitioner claimed that under articles 19 and 21(a) of the Constitution, the state had the right to prescribe qualifications necessary for admission, while private unaided colleges had the right to admit students of their choice. Hence, it would also be unfair to apply the same rules and regulation to both aided and unaided professional institutions.
