It is confirmed news that only four writ petitions have been filed against the 54 (b) clause. Three of the candidates who have filed the writs have withdrawn.Only one case is pending which is not yet taken up for hearing. There is no strong defence on behalf of non-service candidates. This clause has been included from this academic year 2008-2009 only which affects the merits of eligible non-service medicos who may lose the chance of getting some lucrative pg seats.Even if we are selected under non-service category we are bound by the bond to serve tn government for a period of minimum 2 years. i don't why tamil nadu government discriminates the merits non-service medicos. I think we ve to act soon…since hardly 150 seats would be available for non-service candidates which curbs the merits of non-service candidates.so far no one has organized to protest against this absurd clause which blatantly favours service candidates.so friends lets protest against this absurd clause..

[b]Tamil nadu has 914 pg seats = 428 degree seats + 486 post graduation seats

Among this 50% is allotted to all India

So we get only 243 degree seats + 214 diploma seats

Among this 50 % is allotted to service and 50 % to non service till 2007-2008

But now according to the new 54 (b) clause the below seats are reserved exlusively for service candidates

1) MD Pathology =8
2) MD Physiology =6
3) MD Bio-Chemistry =4
4) MD Microbiology = 8
5) MD Forensic Medicine = 2
6) MD Pharmacology = 5
7) MD SPM = 2 7) DMRD 18
8) MD Psychiatric Medicine = 4
9) MD Radio Diagnosis = 5
10) MD Radiotherapy = 4
11) MD Anaesthesia = 18
12) MD TB & Chest Diseases = 2
13) 5 year M.Ch.(Neuro Surgery) = 4
14) M S Anatomy = 5

Total no of pg degree seats exclusively reserved for service candidates = 77

Total no of pg diploma seats (dmrd =18 + dmrt = 6) exclusively reserved for service candidates = 24

Now lets calculate the seats available for non-service candidates
Among 243 pg degree seats 77 seats exclusively reserved for service = 166 seats. Among this 166 seats 50 % seats are allotted to non-service candidates which means

Non service candidates get only 83 pg degree seats ….applying the same formula we get 95 pg diploma seats and also do remember service candidates selected in open category are eligible to compete for these seats also.

Non service candidates get 83 pg degree seats and 95 pg diploma seats . Among the seats available there is all probability of losing 34 pg degree seats to service candidates who can get selected in open competition also..

WE HAVE A MEAGRE SHARE OF 49 PG DEGREE SEATS......This is a real shocker for all non-service candidates.its high time we should unite to fight for our justice. If you are really serious about filing a case, please give your real name. As soon as the case is filed, every one will know your name.

Giving the real name will give more credibility

Please see AIPGE forum. All those who had fought court cases have given their real names only

I DON'T WANT TO SHOW MY CREDIBILITY TO A PERSON WHO WANTS TO FAVOUR SERVICE CANDIDATES

anyway if no one is replying in this thread.i shall file a case as soon as the rank list is out.i shall fight all alone to get my my seat.

since u ve quoted few law points in favour of service candidates. We hereby inform you and your service friends that we ve got a major ruling in favor of non-service candidates given by Andhra pradesh high court which quashed any kinda exclusive reservation of md/ms seats (other than quotas ) for anyone other than merits....which indirectly implies that there shouldn't be nay kind of exlcusive reservation of non-clinical and or few clinical subjects based on non-service and service.
