RxPG - Supreme Court Stayed State PG Admissions

The Supreme Court Monday stayed admissions to post-graduate medical courses across the country on a plea that the admission norms were not being followed.

A bench comprising judges R.C. Lahoti, Ashok Bhan and Arun Kumar stayed the allotment of seats on the basis of counselling which ended Monday and referred the issue to a five-judge constitution bench.

The three-judge bench stayed the admissions on a petition by a doctor alleging the centre had not implemented a constitution bench judgment of November 4, 2003, under which 50 per cent of seats were to be allotted on the basis of an all-India examination and the remaining 50 percent were reserved for "institutional preference" candidates.

Petitioner Saurav Chaudry contended this year's admissions were being conducted on the basis of the previous policy under which 25 percent seats were reserved for the all-India quota and 75 per cent for "institutional preference" candidates.

Meanwhile, the centre filed an application Monday urging that this year's admissions be conducted on the basis of the previous policy since the admission notification was issued on October 27, 2003, eight days before the Supreme Court ruling on the issue.
